Overview
These terms govern your use of huegoo.com and the Huegoo product during early access. They are written in plain language and are intended to be readable. Defined terms appear in bold the first time they're used.
Acceptance of terms
By using the website, applying to the design partner program, or using the product, you agree to these terms. If you don't agree, don't use the service. If you're using Huegoo on behalf of an organization, you confirm that you have the authority to bind that organization to these terms.
The service
The service is the Huegoo product, the website at huegoo.com, and any related materials. The service is in early access. Features may change, be added, or be removed as we learn from design partners. We will notify active users of material changes.
Eligibility
You must be at least the age of legal majority in your jurisdiction. The service is for business use; consumer use is not supported. Access during early access is granted by invitation through the design partner program.
Accounts and access
You are responsible for the security of your account credentials, for the activity that happens under your account, and for keeping your contact information current. Notify us promptly through the design partner application form if you suspect unauthorized access.
Acceptable use
You agree not to:
- Use the service for any unlawful purpose or in violation of any applicable law.
- Upload content you don't have the right to use, or that infringes the rights of any third party.
- Attempt to reverse-engineer, decompile, or extract the source code of the service.
- Probe, scan, or test the vulnerability of the service without prior written authorization.
- Use the service to generate or distribute deceptive content, spam, or malware.
- Resell, sublicense, or otherwise commercialize the service or any output from it without our written consent.
Your content
Your content means the briefs, source files, prompts, and other materials you upload to the service. You retain all ownership rights to your content. You grant us a limited, non-exclusive license to process your content solely for the purpose of operating and improving the service for you, in line with our privacy policy and security overview.
We do not use your content to train third-party foundation models. Where third-party model APIs process your content during a generation, they do so under enterprise terms that prohibit provider-side training on your inputs.
Intellectual property
The service, the website, our brand assets, and all related intellectual property are owned by Huegoo. We grant you a non-exclusive, non-transferable, revocable license to use the service for your internal business purposes during your authorized access.
Output produced by the service from your content is yours to use, edit, and distribute, subject to your obligations under these terms and applicable law.
Confidentiality
Each side will protect the other's non-public information with the same care it gives its own confidential information, and at minimum a reasonable standard of care. Information already public, independently developed, or rightfully received from a third party is not confidential. Either side may disclose information when required by law, with reasonable notice to the other where permitted.
Disclaimers
The service is provided "as is" and "as available" during early access. We make no warranty that the service will be uninterrupted, error-free, or fit for any particular purpose. Output produced by the service is intended to support your judgment, not replace it. You are responsible for reviewing output before using it in business decisions.
Limitation of liability
To the fullest extent permitted by law, neither side is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising from or related to these terms or the service. Each side's total liability under these terms is limited to the fees paid to Huegoo by you in the twelve months immediately preceding the claim, or, during early access where no fees have been paid, the amount of one thousand U.S. dollars.
Termination
Either side may terminate access to the service at any time and for any reason. On termination, your right to use the service ends, but obligations that by their nature survive termination (intellectual property, confidentiality, disclaimers, limitation of liability) continue.
Changes to these terms
We may update these terms from time to time. When we make material changes, we will update the "Last updated" date above and, for active users, notify you through the product. Continued use of the service after a change means you accept the updated terms.
